Export Compliance

How we approach New Zealand export controls, sanctions, product certification, and the responsibilities we share with our partners.

1. Our commitment

PureKiwis is committed to trading lawfully. We will not knowingly participate in a transaction that breaches New Zealand export or import law, the sanctions regimes New Zealand implements, or the import requirements of a destination market.

We may decline or discontinue any enquiry, shipment, or partnership where we are not satisfied that it can be completed compliantly.

2. New Zealand export framework

Goods leaving New Zealand are subject to a number of regimes, including:

  • Customs and Excise Act 2018 — entry, clearance, and documentation requirements administered by the New Zealand Customs Service.
  • Customs Export Prohibition Order — controls on strategic and dual-use goods, which require a permit from the Ministry of Foreign Affairs and Trade before export.
  • Animal Products Act 1999 and Food Act 2014 — verification, registration, and official assurance requirements for animal and food products, administered by the Ministry for Primary Industries (MPI).
  • Wine Act 2003 and Agricultural Compounds and Veterinary Medicines Act 1997, where relevant to the product.
  • Biosecurity Act 1993 — including phytosanitary certification for plant products.

3. Sanctions and restricted parties

New Zealand implements United Nations Security Council sanctions through the United Nations Act 1946 and associated regulations, and maintains autonomous sanctions under the Russia Sanctions Act 2022.

We do not deal with individuals, entities, or destinations subject to applicable sanctions, and we screen enquiries where the destination, counterparty, or goods give us reason to. If a proposed transaction would breach a sanctions measure, we will not proceed.

4. Product certification and market access

Most consumer goods require documentation before they can enter a destination market. Depending on the product and market, this can include:

  • an MPI export certificate or official assurance for food, animal, or plant products;
  • a phytosanitary certificate for plant-based goods;
  • a certificate of origin, including preferential certificates under free trade agreements;
  • ingredient, allergen, nutrition, and country-of-origin labelling compliant with the destination market;
  • product registration or notification with the destination market's regulator, which is common for supplements, cosmetics, and therapeutic products; and
  • evidence supporting any claim made about the product, including organic, sustainability, and provenance claims.

Requirements are product-specific and market-specific, and they change. Nothing on this website should be treated as confirmation that a particular product may be exported to a particular market.

5. Claims and fair trading

Product claims made in New Zealand must not be misleading or deceptive under the Fair Trading Act 1986, and "Made in New Zealand" or similar origin claims must be substantiated. We expect partner brands to be able to evidence the claims they make about their products, and we may ask for that evidence before we represent a product in-market.

6. What we ask of our partners

If you work with us, you agree to:

  • provide accurate and complete product, ingredient, and origin information;
  • hold and maintain the registrations, licences, and certifications your product requires;
  • tell us promptly of any product recall, safety issue, regulatory action, or change to formulation or origin;
  • not ask us to misdescribe goods, undervalue a shipment, or alter documentation; and
  • comply with applicable anti-bribery and anti-corruption law, including the Crimes Act 1961 provisions on bribery of foreign public officials.

7. What we do not do

We are not a licensed customs broker, and we do not act as an exporter of record unless expressly agreed in writing. Unless our written agreement says otherwise, responsibility for the accuracy of customs declarations and for holding required permits rests with the exporter or importer of record.
